We were completely amazed and thrilled to find that we had been selected as one of the top 100 UK restaurants by The Times newspaper on Sunday February 5th 2017. When we look at the restaurants that appear in the list - even just for the South West - we feel both humbled and proud to be in such illustrious company. Our goal is to continue to continue to offer you top quality food at reasonable prices.

For 22 years
Square Meal has been the market-leading independent restaurant commentator, with up-to-date reviews of 5,000 London and UK restaurants and bars, written by a team of independent critics with the aid of comments from thousands of restaurant customers. The site is updated throughout the year. Restaurants do not pay for inclusion.

When we say ‘we’, ‘us’ or ‘Ben’s Cornish Kitchen’ it’s because that’s who we are and we own and run the Site.

What personal data we collect and why we collect it
When you visit this site the personal data we collect from you relates to information you supply when
- using our contact form i.e. your name and email address so that we can reply to you
- ◇signing up for our Newsletter i.e. your name and email address. This data is processed by MailChimp to enable us to send you updates and other marketing information.
- *the purchase of physical Gift Vouchers i.e. your name and email address and the name and address of the recipient, if applicable

*When making a purchase from our site this is processed by WooCommerce using both PayPal and Stripe as our payment processors. You will be required to enter your details to complete your purchase. However, we do not collect any transactional data from you on the website. All transactions are handled directly by them. When making a making a booking and paying a deposit, we use both PayPal and Stripe as our payment processors.

Contact forms
If you use a contact from on the website, we require your name and email address. Our contact form then sends this information as an ordinary email to us. The information you provide is not stored on the website. We will attempt to respond to you within 24 hours. Any email from us will come from our domain and have a name followed by @benscornishkitchen.com
When you send us an email or use the contact form, your details are only used for customer service purposes. Your details will not be used for marketing purpose and you will not be added to our mailing list unless you specifically use the sign up form.
Cookies
To make this site work properly, we sometimes place small data files called cookies on your device. Most big websites do this too.
What are cookies?

Who we share your data with
We do not share your data directly with any third parties. When you make purchases our payment providers will require personal information from you which may include, name, address, email and payment details for processing your payment.
If you purchase physical gift vouchers, you will be directed to PayPal’s site for payment. PayPal have their own privacy policy which can be found here.
If you purchase online Gift Cards, the data is processed by either PayPal or Stripe (our credit card payment gateway). Stripe’s privacy policy can be found here.
When you make an online reservation with Ben’s Cornish Kitchen, this is done through SimpleERB. You can view their privacy policy here. Deposits will be taken via PayPal or Stripe. See details above.
If you sign up to our mailing list, this data is handled directly by MailChimp. You can read their privacy policy here. You can unsubscribe from our mailing list at any time by clicking the ‘Unsubscribe’ link in any newsletter email you have received from us.
How long we retain your data
We keep contact form entries for six months, analytics records for a year, and customer purchase records for ten years (for accounting purposes).
If you leave a comment, the comment and its metadata are retained indefinitely. This is so we can recognize and approve any follow-up comments automatically instead of holding them in a moderation queue.
What rights you have over your data
Controlling your personal information
You may choose to restrict the collection or use of your personal information in the following ways:

We will not sell, distribute or lease your personal information to third parties unless we have your permission or are required by law to do so.
If you have left comments on this website, you can request to receive an export file of the personal data we hold about you, including any data you have provided to us. You can also request that we delete any personal data we hold about you. This does not include any data we are obliged to keep for administrative, legal, or security purposes.
Where we send your data
As mentioned previously, MailChimp process our sign up forms and newsletters. The data they process may be processed within the EU and in the US. European data protection law requires that data about European residents which is transferred outside the European Union to be safeguarded to the same standards as if the data was in Europe.
MailChimp has annually certified their agreement to EU/US and Swiss Safe Harbor Frameworks since 2007. Since the Safe Harbor Frameworks have been replaced by the EU-U.S. Privacy Shield Framework and the Swiss-U.S. Privacy Shield Framework, they have certified their agreement with these Privacy Shield Frameworks. See their Privacy Policy for more details. We have a data processing agreement with Mailchimp for this reason that you can read here. This safeguards any data processed by them.
Visitor comments may be checked through an automated spam detection service. This may be located abroad.

How we protect your data
Our website is a secure site and you will notice the small green padlock and the word Secure next to it in the address bar. This means that any data transferred from our site to any of our partners mentioned above is encrypted. Access to our booking system, payment processors and website control panel is restricted to authorised staff only who have had staff training in data protection issues. We use complicated passwords on devices that have access to our systems.
What data breach procedures we have in place
Your data is massively important to you – and us. At the back end of our website we use a system called Wordfence which provides a firewall between our site and the internet. You can read about it here. If we were to suspect there were to be a breach in our data processing, we would immediately suspend our website to investigate and change all relevant passwords on all devices that have access to our ‘backend’ systems. Only when we were sure that the data breach had been dealt with would we take our site back online. If the data breach took place through one of our data processing partners, we would send an email to you explaining the situation and their recommendations.
Terms and Conditions
Booking Policy
The booking contract:
We both need a contract so that your rights and our rights are protected. We have tried to make these as brief and clear as possible. The booking is with us. Your contract is with us and not with simpleERB.com or 5pm Ltd who provide the booking technology.
By using the Service you are deemed to have accepted these terms and conditions of use. You need to have the legal capacity to make a booking. You must provide true and accurate information. You are entering into a contract with us which means that you have to pay for the meal once you have eaten it, unless you have made any full or partial pre pay arrangements.
The contract becomes legally binding on us only when you have received the confirmation email. You can cancel the booking via the cancellation link in your booking email.
If you don’t turn up at the restaurants at or near the specified time we reserve the right to charge you a “no show” fee. If you turn up with less than your booked number of people we reserve the right to charge you a partial “no show” fee. If you turn up late at the restaurant we reserve the right to give away your table(s), although we will always endeavour to accommodate you at a later time if possible.
We reserve the right to cancel your booking if we are unable to provide the service to you.
When booking a table, we will request a deposit of £10 per cover which will be taken 24 hours before your meal unless you pay it earlier and credited to your bill. You may cancel up to 24 hours in advance for a refund, after that time there will be no refund.
Credit cards:
If we have asked you for a credit card number, we reserve the right to make a charge to this card for any of the reasons described above. We do not store credit card details nor do we share customer details with any 3rd parties.
Refund Policy
If you have purchased Gift Vouchers or Gift Cards and we have been unable to deliver theses on time within reason, then you will be refunded the full amount to your PayPal account when we receive the Vouchers or Cards back to the restaurant. Privacy
You will receive emails from us relating to confirmation of your booking.
Liability:
Our booking technology partners, simpleERB.com and 5pm Ltd strive for the highest levels of security but please note that information carried over the internet is not 100% secure. Neither we nor our booking technology partners accept any liability for loss, damages or costs associated with the use of this service, including viruses, data loss or consequential loss. We try and keep our data up to date but we accept no responsibility for any damage or consequential loss arising from inaccurate data or your reliance upon it.
Rights and jurisdiction:
We reserve the right to vary these terms and conditions at any time. The onus is on you to check the current terms and conditions.
Delivery
- If you buy Gift Vouchers or Gift Cards, we will seek to dispatch these within 3 days from payment.
